                   AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS
                   AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS
                   TO REZONE A TRACT OF LAND LOCATED AT 138 MARKET
                   STREET, BEING ON THE NORTHWEST LINE OF MARKET
                   STREET AT EAST 2ND STREET, FROM R-4 SPECIAL
                   ZONE AND M-1 MANUFACTURING ZONE TO C-3 CENTRAL
                   BUSINESS ZONE, SUBJECT TO CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as
         amended, known as the Zoning Ordinance, be and the same is 
hereby
         amended so as to rezone:
                A tract of land located at 138 Market Street, being
                on the northeast line of Market Street at East 2nd
                Street.  The south 91 feet of lot 6, Market Street,
                Original Plan of the Town of Chattanooga, not
                recorded; being the property described in deed book
                2044, page 529, ROHC.  Tax Map No. 135L-B-6.
               
               
         from R-4 Special Zone and M-1 Manufacturing Zone to C-3 Central 

         Business Zone.
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this rezoning 

         shall be subject to the following conditions:
              1.   Recommendations by the Downtown Riverfront
              	   Design Studio as follows:

                   a)	Brick facade will be clean, pointed and
                        properly rehabilitated.
                  
                   b)	Existing second level windows will be repaired
                        or replaced to match.
                  
                   c)	One new opening on north wall to match similar
                        opening on south wall is approved.
                  
                   d)	The two end bay garage-type openings on Market
                        Street will be infilled with a proportional
                        wood frame storefront on a brick base recessed
                        2" minimum.
                  
                   e)	The central entry bay will have a 14' wide 10'
                        setback area defined by two 6" x 6" industrial
                        columns.  The store entries are to be wood
                        frame fronts similar to store front with glass
                        base panel.
                  
                   f)	Mr. Rothwell will bring to the Design Center
                        details, colors, signage and any on-site
                        required changes for approval.
                  
              2.   All existing easements are retained.
        
        
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage, as
         provided by law.
